PilotAssists, ChecklistAssist & PilotBrain – Terms of Service & Usage Policy

These Terms of Service and Usage Policy (“Terms”) govern your access to and use of PilotAssists, ChecklistAssist and PilotBrain (together “we”, “us”, “our”), including our website(s), digital tools, calculators, decoders, downloads, access codes, educational resources, and any physical products we sell (collectively, the “Services”).

By accessing, purchasing from, or using our Services, you agree to these Terms. If you do not agree, do not use the Services.

1. About PilotAssists & PilotBrain

PilotAssists and PilotBrain provide aviation-related educational and informational tools and resources designed to assist pilots, student pilots, and aviation enthusiasts.

We do not provide certified or authority-approved services such as:

  • Licensed flight instruction

  • Operational control

  • Aircraft maintenance services

  • Regulatory advice

  • Official weather briefings
    unless explicitly stated in writing.

2. Eligibility

By using our Services, you confirm that:

  • You are legally capable of entering into a binding agreement, or

  • If you are under 18, you have permission from a parent or legal guardian.

3. Educational & Informational Use Only

All content, products, and tools provided by PilotAssists and PilotBrain are for general informational and educational purposes only.

They are not a substitute for:

  • Approved flight training

  • Aircraft flight manuals/POHs/AFMs

  • Airline/operator SOPs

  • Regulatory publications

  • Approved operational or weather briefings

  • ATC instructions or authority guidance

You remain solely responsible for all aviation decisions, actions, and outcomes.

4. No Guarantees & Meaning of Language

We make no guarantees, warranties, or representations of any kind about the accuracy, completeness, suitability, or outcomes of using our Services.

Important clarification on wording

Words and phrases such as “will”, “means”, “indicates”, “translates to”, “should”, “recommended”, “best practice”, “expected”, “aims to”, “designed to”, “helps”, or similar expressions are used for descriptive, educational, or illustrative purposes only.

They do not:

  • Guarantee outcomes

  • Promise accuracy

  • Confirm safety

  • Ensure regulatory compliance

  • Ensure suitability for any specific aircraft, operation, or jurisdiction

Outcomes and results may vary based on user interpretation, training, experience, aircraft type, environment, and external factors.

All Services are provided “as-is” and “as-available.”

5. METAR Decoder & Weather Tools Disclaimer (Including CAA-Style Transcriptions)

We provide a METAR decoder and related weather tools that interpret aviation weather reports.

These tools:

  • Are provided for educational and informational purposes only

  • Use publicly available METAR formats, including CAA-style transcriptions and phraseology

CAA clarification

References to CAA-style wording or transcriptions:

  • Do not mean endorsement, approval, or verification by the UK Civil Aviation Authority (CAA)

  • Do not constitute an official weather briefing

Limitations

  • Outputs may be simplified, delayed, incomplete, or inaccurate

  • Weather can change rapidly and may not match decoded outputs

  • The same METAR may be interpreted differently by different authorities, instructors, operators, or jurisdictions

Any words such as “will”, “means”, “indicates”, or “translates to” within the decoder describe typical interpretations only, not guaranteed conditions.

You must always use official aviation weather sources, approved briefings, and your own training and judgment.

6. PilotBrain – AI-Powered Assistance Disclaimer

PilotBrain is an AI-powered assistance tool intended to provide general aviation-related information, explanations, and guidance for educational purposes only.

PilotBrain is not:

  • A licensed pilot

  • A flight instructor

  • A maintenance engineer

  • A dispatcher

  • An air traffic controller

  • A regulator or aviation authority

  • A replacement for human judgment, manuals, or approved procedures

PilotBrain does not provide certified, approved, or authoritative aviation advice.

PilotBrain is provided strictly for educational and supplementary training purposes and is not certified, approved, or intended for use in live flight operations, operational decision-making, navigation, performance calculations, or any real-world aviation activity.

7. No Reliance / Verification Requirement (PilotBrain and All Tools)

PilotBrain and other tools generate responses based on general knowledge and user inputs. As a result, outputs may be incorrect, incomplete, outdated, or unsuitable for your operation.

You agree that PilotBrain and our tools must never be relied upon as the sole source of information for:

  • Aircraft operation

  • Flight planning

  • Weather decisions

  • Maintenance actions

  • Emergency procedures

  • Training assessment or operational decision-making

  • Any real-world aviation decision

You agree to independently verify information using official sources (manuals, checklists, approved publications, instructors, operators, authorities, and/or official weather briefings).

8. Explicit Aircraft Damage, Equipment Damage & Loss Disclaimer

To the maximum extent permitted by law, PilotAssists and PilotBrain accept no responsibility or liability for any loss, damage, cost, or incident arising from the use or misuse of our Services, including but not limited to:

  • Damage to any aircraft, vehicle, simulator, avionics, engine, or equipment

  • Maintenance actions taken based on PilotBrain or tool outputs

  • Incorrect configuration, setup, or operation of aircraft or systems

  • Financial loss, operational disruption, delays, diversions, or cancellations

  • Injury, property damage, or third-party claims

This applies even where a user claims to have followed output that used terms such as “will”, “should”, “recommended”, “best practice”, or similar language.

All decisions and actions remain entirely the responsibility of the user.

9. No Emergency Use

PilotBrain and our tools must not be used for in-flight or operational emergencies, abnormal situations, or time-critical decision-making.

In all cases, follow:

  • Aircraft checklists and approved manuals

  • Operator procedures and instructor guidance

  • ATC instructions

  • Applicable aviation authority regulations

10. PilotBrain Access Codes (Digital Product)

We sell PilotBrain access codes via our website. Access codes are digital products.

  • Delivery may be automated

  • Access is provided as-is

  • We do not guarantee uninterrupted availability of any service, platform, or feature

  • You are responsible for keeping access codes secure and not sharing them

Refunds for access codes

Once an access code has been issued or delivered, all sales are final, except where required by law.

We are not responsible for issues caused by:

  • User error or misuse

  • Device, browser, or software compatibility

  • Third-party outages beyond our reasonable control

11. Digital Products (General)

Unless otherwise stated, digital purchases are provided:

  • As-is

  • As-available

  • Without any guarantee of suitability for a specific purpose

Due to the nature of digital products, all sales are final, except where required by law.

12. Physical Products (Printful Fulfilment)

Some physical products sold on our website are produced and fulfilled by third-party providers, including Printful.

By purchasing physical products, you acknowledge:

  • Items are typically made-to-order

  • Delivery estimates are not guarantees

  • Colours, sizing, and finishes may vary slightly from on-screen previews

Returns & Refunds (Physical Products)

Returns/refunds are generally limited to:

  • Items that arrive damaged

  • Items that are defective

  • Items that are incorrect due to an error on our side or fulfilment partner’s side

We do not generally accept returns for:

  • Wrong size selected by the customer

  • Change of mind or preference

  • Normal wear and tear

Where applicable, replacement/refund decisions may depend on third-party fulfilment partner policies.

13. Accuracy of Information

We aim to keep information helpful and current, but aviation rules, phraseology, procedures, and best practices change frequently. Errors or omissions may occur.

We do not guarantee accuracy, completeness, or timeliness. Users must verify information independently.

14. Intellectual Property

All content, branding, tools, product designs, and materials are owned by PilotAssists and/or PilotBrain (or our licensors) unless stated otherwise.

You may not:

  • Copy, reproduce, resell, redistribute, or publicly share paid materials

  • Modify or create derivative works from our content (except where legally permitted)

  • Claim ownership of our materials

15. Changes to Services or Terms

We may change or discontinue parts of the Services, update features, adjust pricing, or update these Terms at any time.

Continued use of the Services after changes means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes shall be handled in the courts of England and Wales, unless consumer law requires otherwise.

ChecklistAssist does not provide advice, instructions, guidance, recommendations, or approvals of any kind, whether operational, professional, technical, medical, legal, aviation-related, safety-critical, or otherwise.

All content within ChecklistAssist is:

  • Created entirely by the user, or

  • Entered manually by the user

ChecklistAssist does not verify, validate, review, endorse, certify, or guarantee the accuracy, completeness, reliability, legality, suitability, or safety of any checklist, checklist item, or associated content.

No Professional or Operational Advice

ChecklistAssist is not:

  • A certified aviation product

  • A safety system

  • A training tool

  • A compliance tool

  • A substitute for professional judgment, approved manuals, training, or manufacturer procedures

Nothing within ChecklistAssist should be interpreted as:

User Responsibility

By using ChecklistAssist, the user acknowledges and agrees that:

  • They are fully and solely responsible for all checklists created, modified, stored, or used

  • They assume all risks associated with the use or misuse of any checklist

  • They are responsible for ensuring checklist accuracy, relevance, legality, and safety

  • They understand that incorrect, incomplete, outdated, or inappropriate checklists may result in damage, injury, loss, or death


ChecklistAssist is provided strictly for educational and supplementary training purposes as a digital organisational tool; while the software framework is developed by us, all checklist content is created and maintained by users, the platform is not certified, approved, or intended for use in live flight operations or real-world aviation decision-making, and any use is undertaken solely at the user’s own risk and responsibility.

Limitation of Liability

To the maximum extent permitted by law, PilotAssists, ChecklistAssist, and all associated parties (including developers, owners, affiliates, and contributors) shall not be liable for any:

  • Direct or indirect loss

  • Personal injury or death

  • Property damage

  • Financial loss

  • Business interruption

  • Regulatory or legal consequences

  • Operational failure

  • Human error

  • Equipment damage

  • Aircraft damage or incidents

  • Any incidental, consequential, or special damages

This applies regardless of cause, including but not limited to:

  • User error

  • Incorrect checklist content

  • Misinterpretation

  • System errors

  • App malfunction

  • Software bugs

  • Omission or delay

  • Reliance on checklist content

Use of ChecklistAssist is entirely at the user’s own risk.

No Guarantees

ChecklistAssist is provided “as is” and “as available”, with no warranties of any kind, express or implied, including but not limited to:

  • Accuracy

  • Reliability

  • Fitness for a particular purpose

  • Availability

  • Error-free operation

Acceptance

By accessing or using ChecklistAssist, the user confirms that they:

  • Have read and understood this disclaimer

  • Accept full responsibility for their actions

  • Agree that PilotAssists and ChecklistAssist bear no liability whatsoever

If the user does not agree with any part of this disclaimer, they must not use ChecklistAssist.
